Non-Discrimination Statement & Title IX
Harassment or discrimination because of an individual’s race, color, national origin, ancestry, religion, sex, disability, age, genetic information, or any other characteristic protected by law is prohibited in this District.  The District also prohibits retaliation against a person who files a complaint of discrimination or harassment or participates in an investigation of allegations of harassment or discrimination.

This Regulation governs and outlines the procedure for filing a complaint of harassment or discrimination based on a protected classification by students, employees, parents, and patrons of the District. Students with a complaint regarding the identification, evaluation, educational program, or placement of a child with a disability under Section 504 of the Rehabilitation Act of 1973 should be filed in accordance with the procedures outlined in Regulation 2110.

The District has designated the Compliance Officer with the responsibility to identify, prevent, and remedy unlawful discrimination and harassment in the District.  The Compliance Officer is in charge of assuring District compliance with this Policy and Regulation, Title IX of the Education Amendments of 1972; Title VII of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973; as well as other state and federal nondiscrimination laws.

 

The District’s Title IX Coordinator should be contacted regarding any inquiries as to the application of Title IX, issues related to discrimination generally, or filing a harassment complaint.

    COMMITMENT TO COMPLIANCE UNDER THE AMERICANS WITH DISABILITIES ACT 

    In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (“ADA”), the Hallsville School District will not discriminate on the basis of disability against qualified individuals with a disability with respect to its services, programs, or activities. Employment: The District does not discriminate on the basis of disability in its hiring or employment practices. The District complies with the federal regulations under Title I of the ADA (which governs the application of the ADA in the hiring and employment setting). Effective Communication: The District will comply with the ADA with respect to providing auxiliary aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in its programs, services, and activities. These aids and services are designed to make information and communications accessible to people who have impairments, in areas such as speech, hearing, and vision. The District will not place a surcharge on a qualified individual with a disability, or any group of qualified individuals with disabilities, to cover the cost of providing auxiliary aids/services or reasonable modifications of policy (for example, retrieving items from locations that are open to the public but inaccessible to users of wheelchairs). Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a service, program, or activity of the District should contact the Compliance Coordinator, whose contact information is listed in the District’s Notice of Nondiscrimination. Such contact should be made as soon as possible, but not later than 48 hours before the scheduled event (and, preferably, at least five (5) business days before the event). Modifications to Policies and Procedures: The District will make reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy its services, programs, and activities. However, the ADA does not require the District to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.

    504 PUBLIC NOTICE 

    The Hallsville R-IV Public School District, as a recipient of federal financial assistance from the United States Department of Education and operates a public elementary or secondary education program and/or activity, is required to undertake to identify and locate every qualified person residing in the District who is not receiving a public education; and take appropriate steps to notify disabled persons and their parent or guardians of the District’s duty. 

     

    The Hallsville R-IV Public School District assures that it will provide a free appropriate public education (FAPE) to each qualified disabled person in the District’s jurisdiction, regardless of the nature or severity of the person’s disability. For purposes of Section 504 of the Rehabilitation Act of 1973, the provision of an appropriate education is the provision of regular or special and related aids and services that (i) are designed to meet individual educational needs of disabled persons as adequately as the needs of nondisabled persons are met and (ii) are based on adherence to procedures that satisfy the requirements of the Section 504 federal regulations.

    The Elementary and Secondary Education Act requires certain notifications to parents and guardians when school districts receive federal funds. School districts must annually disseminate federal programs complaint resolution procedures to parents and guardians of students and appropriate private school officials or representatives.     Family Educational Rights and Privacy Act (FERPA) Directory Information 

    Schools may disclose, without consent, "directory" information including: a student's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance. However, parents may request that the school not disclose directory information about them. This means that should a parent revoke directory information, the student’s name will not appear in any newspaper article, printed in any school program, appear on any district web page, or be announced at any school event (including, but not limited to, sports, plays, and award ceremonies). Parents have 15 days from the beginning of school or the 

    date of enrollment to revoke directory information. This request must be provided in writing and will be considered valid for the remainder of the current school year.

    IDEA PUBLIC NOTICE 

    All responsible public agencies are required to locate, evaluate, and identify children with disabilities who are under the jurisdiction of the agency, regardless of the severity of the disability, including children attending private schools, children who live outside the district but are attending a private school within the district, highly mobile children, such as migrant and homeless children, children who are wards of the state, and children who are suspected of having a disability and in need of special education even though they are advancing from grade to grade. The Hallsville R-IV School District assures that it will provide a free, appropriate public education (FAPE) to all eligible children with disabilities between the ages of 3 and 21 under its jurisdiction. Disabilities include autism, deaf/blindness, emotional disorders, hearing impairment and deafness, intellectual disability, multiple disabilities, orthopedic impairment, other health impairments, specific learning disabilities, speech or language impairment, traumatic brain injury, visual impairment/blindness, and young children with a developmental delay. 

     

    The Hallsville R-IV School District assures that it will provide information and referral services necessary to assist the State in the implementation of early intervention services for infants and toddlers eligible for the Missouri First Steps program. 

     

    The Hallsville R-IV School District assures that personally identifiable information collected, used, or maintained by the agency for the purposes of identification, evaluation, placement, or provision of FAPE of children with disabilities may be inspected and/or reviewed by their parents/guardians. Parents/guardians may request an amendment to the educational record if the parent/guardian believes the record is inaccurate, misleading, or violates the privacy or other rights of their child. Parents have the right to file complaints with the U.S. Department of Education or the Missouri Department of Elementary and Secondary Education concerning alleged failures by the district to meet the requirements of the Family Educational Rights and Privacy Act (FERPA). 

     

    The Hallsville R-IV School District has developed a Local Compliance Plan for the implementation of State Regulations for the Individuals with Disabilities Education Act (IDEA). This plan contains the agency’s policies and procedures regarding storage, disclosure to third parties, retention, and destruction of personally identifiable information, and the agency’s assurances that services are provided in compliance with the General Education Provision Act (GEPA).     Notice Requirements for Missouri Schools 

    Surveys: No student, as part of any federally funded program, without parent consent, shall be required to submit to a survey, analysis or evaluation that reveals: political affiliations; potentially embarrassing mental or psychological problems; sex behavior and attitudes; illegal, anti-social, self-incriminating and demeaning behavior; critical appraisals required for participation in the program; religious practices, affiliations or beliefs. Instructional materials used in connection with any of the above are available for public inspection. 

    Searches: The school district may search lockers and other school property used by students. Drug dogs may be used to search lockers, backpacks, purses, and cars parked on school property. 

    Teacher Qualifications: Parents may request information regarding the professional qualifications of their student’s classroom teacher. This information will include whether the teacher is fully, partially, or provisionally certified by the state of Missouri, whether the person is teaching in his/her area of certification, whether the student is provided services by a paraprofessional, the person’s qualifications, and what degrees, endorsements, or certifications are held by the teacher. 

    School District Policies: Copies of the school district policies adopted by the Board of Education are available for public review in the administrative offices and on the district’s website under “Board of Education Policies.”

    Parents' Right to Know Notification

    Per the Every Student Succeeds Act of 2015 (Public Law 114-95), parents have the right to know. Upon your request, our district is required to provide to you in a timely manner, the following information:

    • Whether your student’s teacher has met State qualification and licensing criteria for the grade levels and subject areas in which the teacher provides instruction. 
    • Whether your student’s teacher is teaching under an emergency or other provisional status through which State qualification or licensing criteria have been waived. 
    • Whether your student’s teacher is teaching in the field of discipline of the certification of the teacher. 
    • Whether your child is provided services by paraprofessionals and, if so, their qualifications. 

     

    In addition to the information that parents may request, a building receiving Title I. A funds must provide to each individual parent: 

    • Information on the level of achievement and academic growth of your student, if applicable and available, on each of the State academic assessments required under Title I.A. 
    • Timely notice that your student has been assigned, or has been taught four or more consecutive weeks by a teacher who has not met applicable State certification or licensure requirements at the grade level and subject area in which the teacher has been assigned.

    Parents may audio record any meeting held under the Individuals with Disabilities Education Act (IDEA), the federal law governing special education, such as individualized educational planning meetings (IEP meetings). In addition, parents may record meetings under Section 504 of the Rehabilitation Act of 1973 (Section 504 meetings), which involve the accommodation of students with disabilities. “Please notify Hallsville R-IV School District by contacting your child’s case manager, counselor, or the office of the building where your child attends at least 24 hours prior to the scheduled meeting of your intent to record.

    SURROGATE PARENT NOTICE

     Pursuant to the requirements of State Law 162.997-999 RSMo, the State Board of Education is required to appoint a surrogate parent at such time as it becomes evident that a child with a disability does not have a parent or a person acting as a parent to participate in matters dealing with the provision of special education. For purposes of this requirement, the term may include the biological parent, a guardian, a person acting as a parent of a child, including, but not limited to, a grandparent, a stepparent, or a foster parent with whom the child lives. The term does not include the State if the child is a ward of the State. The term does not include a person whose parental rights have been terminated. The local public school district is given the responsibility to determine when a child with a disability who requires special education and who resides in the District is without a parent. The District must notify the Missouri Department of Elementary and Secondary Education of the need to appoint a surrogate parent. Training for persons serving as surrogate parents will be provided by the Missouri Department of Elementary and Secondary Education and the local public school district. If you are interested in volunteering to serve as a surrogate parent, more information can be obtained from the Director of Special Services in the local public school district.

  •  Get the Lead out of School Drinking Water Act (RSMo 160.077)

    In 2022, the Missouri legislature passed the Get the Lead out of School Drinking Water Act (RSMo 160.077), which sets standards for lead concentrations in school drinking water. The law requires schools to conduct inventory, sampling, remediation, and monitoring at all potable drinking water outlets used or potentially used for drinking, food preparation, and cooking or cleaning utensils. 

    The Environmental Protection Agency (EPA) currently has a lead drinking water standard limit of 15 parts per billion (ppb) of lead in water. However, Missouri law requires that all  Missouri schools achieve a 5 ppb lead limit in water. The deadline for testing under the law is August 2024, and testing within the district began in late December 2023. 

    To comply with the law, our district has completed lead testing in all four buildings. Once the results are available, they will be posted on this page.
